Who Do You Ship With?
As a Canadian company I use Canada Post to form the base shipping price. The prices come directly from the Canada Post website and Canada post shipping is integrated into my shopping cart. At this time I cannot send packages via letter mail as we do not have appropriate tracking for that shipping method. So everything has to be sent as a package. I am continuously on the lookout for other shipping couriers to integrate to be able to offer my clients the best and most cost effective shipping options available. So as the options change, this information will also be updated.
Where Do You Ship?
I ship everywhere we’re allowed to. Some of that becomes a little cost prohibitive for some of my clients as the further away you are from Canada, the more shipping tends to cost. Customers are responsible, however, for any incurred duties, taxes, and fees associated with importing goods into their own country. There are no exceptions for this. Please make sure you’ve thoroughly gone over your own countries import fees and regulations so you’re aware of any additional expenses that may arise before you make a purchase.
Licensing
To see all of my current licensing contracts you can check this page here: Licensing
If you are interested in licensing my work for your merchandise or projects, I do accept inquiries. You can contact me with queries and information regarding your company and what you wish to license the work for. For any licensing agreements I do require a contract to be put in place. None of my work can be used for anything without an agreement in place.
If you are a company that uses AI in the process of making merchandise, sells AI merchandise, or will run my images through any kind of AI software I will have to decline your requests. I am a human artist with strong policies and practices when it comes to the use of AI and I am not interested in facilitating the use of AI in regards to my artwork or art merchandise.
My Account
My site offers the ability to be able to create your own account to make your orders and downloads much simpler to keep track of. If you are purchasing any digital downloads, especially, I highly recommend you create an account. This way all of your downloads can be found in one place should you need them again. In your My Account page you can also change and update your addresses and payment information as needed.
Digital Downloads
I have a shop section which allows users to purchase and download digital items such as Valentines Day cards and colouring pages. As you can imagine, in this digital age, it can sometimes be a risk to offer such things. Any artist has a right to protect their work and set terms for the use of their work. Please see my digital downloads terms of service page for more information. The purchase and download of any digital item from my shop means you understand, accept, and will adhere to these terms. So please make sure to read it in full.
Downloadable products are not available for a return. If you have a problem with your download I would be more than happy to work with you to resolve the issue but refunds will not be issued. It is the responsibility of the purchaser to ensure that what they are downloading is compatible with whichever software or program they are opting to use. Most downloads are available as PDF’s. Adobe Acrobat Reader offers a free PDF program that you can download from their site in which to be able to open your files from. Of course you can choose any PDF reading software of your choice but this one happens to be free.
The files in this section also come compressed in a zip file and so you will need software like WinZip to help you decompress them. This one is also free and both WinZip and Adobe Acrobat Reader have been around for decades. I am not associated or affiliated with either company in any way. This is just what I use myself. Again, you are free to use whichever programs work best for you!
If you are having issues with your download, please feel free to contact me.
AI
The use of AI in anything regarding my website or artwork is prohibited. I did not use AI to create my site, I did not use AI to write anything on my site, I did not use AI to create my works, and I do not accept AI in any form regarding my work or website.
Ai image generators use the works of artists without their permission or compensation in order to train their models. Not only has AI used artists work without permission or compensation, companies are now using AI generated images to profit without having to pay artists. The use of AI has reduced and stolen jobs, using artists own work against them.
My personal stance is that the use of AI is unethical in it’s current state without proper regulations and legal parameters to follow. Maigan Lynn Art and Fantasy In The Hook (the seasonal gallery that I run) have no desire to create any sort of space in which AI is permitted.
Anyone found to be using AI with my images or image files or entering my images into AI software will be permanently banned from my website, shop, social media pages, and there may be legal action taken as well. I do not take this lightly. Once these files or images have been entered into AI programs they have then been used to train the AI which cannot be undone and I do not, under any circumstances, give permission for my work or my files to be used in this way.
Image Use
This section might seem a little redundant as some of it has already been covered in the Licensing section and some of it in the AI section. But I thought it needed to be expanded a little further.
No person, company, or entity, holds any legal right to use my images for any reason without my express permission. In most instances I require a contract for use – whether I’ve licensed with you or have given you permission to use my images for personal use. When you purchase a digital download, upon purchasing and downloading the item it is understood that you accept and will adhere to to the digital download terms of service which are provided as an attachment with every download, available to access from each listing, and available to view in my Digital Downloads section on this very FAQ page. That is a kind of contract. You are accepting terms by way of the actions you are choosing to take and it is understood by both parties.
Images on my website are also not to be used without my permission. These images belong to me, I hold all the rights to them, and so I deem what they can and can’t be used for. You may not take them to run through AI image generators, or use in your projects for profit or personal use without permission or a contract in place. Even if you think the use of the image is benign, it is solely up to me, as the artist, to decide what I will allow my work to be used for and what I won’t allow. Using an image that does not belong to you is the same as stealing products off of a store shelf. It is theft and therefor illegal.
This should go without saying, but no image is to be taken and altered in any way without my express permission. You can not put it through a filter, use it in a digital editing software, remove the watermark, crop it, recolour it, ‘enhance’ it, or adjust it in any way without permission from me, the artist.
Digital items have their own terms of use in which things like the colouring pages are a slight exception to the above stated. They CAN be coloured in digital editing software programs. The images themselves cannot be altered – all line work stays as is – but they can be coloured with whatever creative tools you prefer, as long as it’s not AI. They also cannot be sold or shared for the purpose of extending the agreement to any third party – which means you can’t send these files to your sister Sarah to use as she did not purchase the items herself and therefor has not entered into an agreement with me, the artist, in which to be able to hold copies of these files. You also cannot sell the files as you do not own the rights in which to do so. The agreement you entered when purchasing digital colouring pages gives you permission to use these images for the purpose of colouring or printing for personal use ONLY. Purchasing the downloadable files for personal use does not transfer the rights of the image over to you. You are limited in your use of the images.
What Mediums Do You Use?
When I first started creating my work and considered selling it, my first images that inspired my own style were created in Prismacolor markers on these giant white britstol board pieces a friend had given me at the time. They came from these big black and orange Kodak boxes of x-ray film and they just didn’t have a use for the bristol backing. She already had so many so she gave some to me. And that’s where this journey really started.
Since then I’ve jumped into watercolour, acrylic, liquid oils, digital art (not AI), jewelry making, and woodworking. I’ve started learning to paint on all kinds of surfaces from watercolour and canvas paper to rocks, wood, and cupboard doors. I use quality materials to ensure that my work lasts over time and can be passed down from one generation to the next.
Even the reproductions I print myself are made to last. I have a professional grade Canon printer that has been an absolute workhorse for me. The inks used in my printer are Canon ChromaLife 100+ inks meant to last 100+ years if cared for appropriately. I use Canon papers as well to get the best quality images possible. When I’m printing my vinyl stickers and magnets I make sure to use the best materials possible to produce the best images and products. The materials are not the same as an office printer – I should clear that up. This is a professional printer with professional inks and papers. They are made for quality and professional products.
